These Booking Terms and Conditions apply to bookings made with Nu Know Community CIC (“Nu Know”, “we”, “us” or “our”) by organisations, including schools, colleges, universities, companies, charities, public bodies and local authorities (“B2B Clients”), and by parents, carers and other individuals booking services for personal or family use (“B2C Clients”).
By submitting a booking request, accepting a quotation, confirming a booking, or making payment for a service, you confirm that you have read, understood and accepted these Booking Terms and Conditions.
These terms come into effect once a booking has been confirmed by Nu Know and an invoice or booking confirmation has been issued to the client.
Nu Know is a community interest company providing education, learning, research and community-focused services relating to children, young people, adolescence, parenting, relationships, wellbeing and related areas.
Our services may include, but are not limited to:
The specific services included in each booking will be set out in the relevant quotation, booking confirmation, invoice, programme description or other written agreement between Nu Know and the client.
Nu Know's services are provided for educational and informational purposes.
Our workshops, sessions, resources, discussions and other services are intended to support learning, reflection, discussion and increased understanding. They are not a substitute for professional medical, psychological, therapeutic, psychiatric, legal, financial, safeguarding or other specialist advice or intervention.
Unless explicitly stated otherwise in writing, Nu Know does not:
Information discussed during a session should therefore be understood within its educational context.
Clients and service users remain responsible for deciding whether and how information provided by Nu Know is relevant to their individual circumstances and for any actions or decisions they subsequently take.
Where an individual requires professional advice, assessment, treatment, intervention or support, they should seek this from an appropriately qualified professional or relevant service.
Nu Know agrees to provide the services described in the booking confirmation, quotation or other written agreement between Nu Know and the client.
We will make reasonable efforts to deliver services:
Nu Know may make reasonable adjustments to the content, facilitator or delivery arrangements where necessary, provided that the overall nature and purpose of the agreed service is maintained.
For services involving children or young people, the client organisation or parent/carer remains responsible for ensuring that appropriate arrangements are in place for the child's or young person's participation, including any relevant consent, supervision, accessibility, medical and emergency arrangements that are the responsibility of the client.
Where a booking is made by a school, company, charity, public body, local authority or other organisation, the organisation remains responsible for matters relating to the people accessing the service through it.
This includes, where applicable:
Nu Know's services do not transfer the organisation's existing legal, safeguarding, health and safety or professional responsibilities to Nu Know.
Where a service is delivered on an organisation's premises, the organisation remains responsible for the safety and suitability of those premises and for arrangements that are within its control. Upon request, Nu Know will share their safeguarding policy with organisations, including schools, colleges, universities, companies, charities, public bodies and local authorities (“B2B Clients”).
Where a parent or carer books a service directly with Nu Know, the parent or carer remains responsible for considering whether the service is appropriate for their circumstances and for any decisions or actions taken following the service.
Parents and carers should seek appropriate professional advice where their circumstances require medical, psychological, therapeutic, legal, safeguarding or other specialist support.
Where a service is booked on behalf of a child or young person, the parent or carer remains responsible for providing appropriate consent and supervision unless otherwise agreed in writing.
Unless otherwise agreed in writing:
Where a specialist delivery time package is purchased, the package will be valid for the period specified at the point of purchase.
Unless otherwise agreed in writing, unused hours within a specialist delivery time package will expire at the end of the applicable package period and are non-refundable.
Clients may request additional hours or services during the package period, subject to availability and payment of the applicable additional fee.
Unless otherwise stated, quotations issued by Nu Know are valid for 20 working days.
A quotation does not constitute a confirmed booking.
A booking becomes confirmed when Nu Know has accepted the booking and issued the relevant booking confirmation and/or invoice.
Unless different terms have been agreed in writing:
Where a cancellation is made outside the applicable notice period, Nu Know may retain some or all of the payment already made where this reasonably reflects costs or commitments incurred in preparing for and delivering the booking.
Any applicable cancellation charges will be confirmed in the quotation or booking confirmation where appropriate.
Parents and carers may cancel a booked individual session before the session takes place.
Where an individual session is cancelled with less than two calendar days' notice, or where the client does not attend the booked session without prior notice (“no-show”), Nu Know may treat the session as used and, where applicable, deduct the allocated time from the client's specialist delivery time package.
Any statutory consumer cancellation rights that apply to a particular booking are unaffected by these terms.
Nu Know reserves the right to cancel, postpone or rearrange a service where this is reasonably necessary, including because of facilitator availability, illness, circumstances outside our reasonable control, venue issues, safeguarding concerns or other operational reasons.
Where Nu Know cancels a service and cannot offer a suitable alternative, the client will receive a refund of any payment made for the cancelled service.
Where a service is rearranged, Nu Know will work with the client to identify a suitable alternative date where reasonably possible.
Nu Know does not guarantee that participation in any workshop, session, consultation, training programme, resource or other service will result in a particular outcome.
Educational and community-based work can contribute to knowledge, reflection, discussion and learning, but individual outcomes will vary.
Any examples, case studies, testimonials, statistics, research findings or other information shared by Nu Know are provided to support learning and understanding and should not be interpreted as a guarantee of future outcomes.
Nu Know will provide its services with reasonable care and skill and will make reasonable efforts to ensure that the content and delivery are appropriate for the agreed educational purpose.
However, to the fullest extent permitted by law, Nu Know is not responsible for:
Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited.
In particular, nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot legally be excluded or limited.
Where services are delivered in person at premises provided or arranged by the client, the client is responsible for ensuring that the venue is suitable, accessible and safe for the intended activity and participants.
The client must inform Nu Know in advance of any relevant risks, access requirements, restrictions or other circumstances that may affect delivery.
Nu Know may pause or stop a session where it reasonably considers that continuing would create an unacceptable safety, safeguarding or operational risk.
Nu Know takes safeguarding seriously.
Where information relating to a child, young person or vulnerable person is disclosed during a service, Nu Know may need to take appropriate action in accordance with its safeguarding responsibilities and policies.
Confidentiality cannot be guaranteed where information needs to be shared to protect a child, young person or another person from harm, or where disclosure is otherwise required by law.
Clients should not assume that information shared with Nu Know will remain confidential where safeguarding or legal obligations require action.
Both Nu Know and the client agree to treat confidential information received from the other party appropriately and not to disclose it unnecessarily to third parties.
This does not apply where disclosure:
For B2B clients, any specific confidentiality requirements relating to a project, research activity or commissioned service may be set out separately in writing.
Nu Know may ask B2B clients whether they are willing to be identified as an organisation that has worked with us.
Nu Know will not use an organisation's logo without appropriate permission.
Any use of photographs, videos, testimonials or identifiable information relating to individuals will be subject to appropriate consent and applicable data protection requirements.
B2C clients will not be publicly identified as Nu Know clients without appropriate permission or another lawful basis for doing so.
Clients are welcome to describe their work with Nu Know publicly, provided that any statements made about Nu Know or our services are accurate.
Unless otherwise agreed in writing, materials, resources, presentations, worksheets, frameworks and other content created or supplied by Nu Know remain the intellectual property of Nu Know or the relevant rights holder.
Clients may use materials supplied for their own agreed educational or organisational purposes but must not reproduce, sell, distribute, modify, publish or commercially exploit them without prior written permission from Nu Know.
Where a resource is specifically commissioned by a client, ownership and permitted use will be agreed separately in writing.
Nu Know will process personal information in accordance with applicable UK data protection legislation and our Privacy Policy.
Clients should avoid sharing unnecessary personal or sensitive information with Nu Know, particularly where it is not required for the delivery of the agreed service.
Where a B2B service involves the processing of personal data on behalf of an organisation, additional data protection arrangements may be required and will be agreed separately where applicable.
Nu Know may update these Booking Terms and Conditions from time to time.
The version in force at the time a booking is confirmed will normally apply to that booking unless otherwise agreed in writing.
These Booking Terms and Conditions are governed by the law of England and Wales.
Any disputes will be subject to the applicable courts and dispute-resolution procedures of England and Wales, subject to any mandatory rights that apply to consumers.
By submitting a booking request, accepting a quotation, confirming a booking or making payment for a Nu Know service, you confirm that you have read and accepted these Booking Terms and Conditions.
For B2B bookings, the person making the booking confirms that they are authorised to enter into the booking on behalf of the organisation.
For B2C bookings, the individual making the booking confirms that they are entering into the booking for themselves and/or on behalf of the relevant parent, carer or service user where applicable.
